Who are not entitled to an inheritance?

There are 3 types of people who are not entitled to an inheritance even though they are included in the Ashabul Mirath or the people allowed to gain inheritance:

  • Convicted murderer.
    If the deceased was murdered, the killer is not eligible for inheritance although he is an inheritor. The Prophet (P.B.U.H) said: “Whoever kills someone, he is not entitled to inherit from the person he killed, even if the killed has no other heir other than the killer, even if the killer is father or son to the one killed. For murderers there is no right to inherit” (H.R. Ahmad).
  • Different religion
    An inheritor who is of different religion from the deceased is not eligible to receive the inheritance. Different religion – An inheritor who is of a different religion from the deceased is not eligible to receive the inheritance. The Prophet (P.B.U.H) said: “A Muslim cannot inherit from a non-Muslim and non-Muslim cannot inherit from a Muslim” (Muttafaq ‘Alaih).
  • Slavery
    An Inheritor who has become a slave cannot inherit. His possession, by default, is owned by his owner including inheritance.
